You mean to say that someone has won a case and set a precedent. However
such precedents don't mean much in other countries and we don't want to have US
and international versions of the Linux kernel...

Also it takes money to win a law suit. If someone is willing to spend $100K
to sue a Linux developer then who is going to pay for the defence?
